The couple's neighbor, Ivory Madison, a trained attorney and writing coach, documented the injuries at his wife's request and later reported the incident to police.

Since the investigation began, Mirkarimi's wife, Eliana Lopez -- a former telenovela star in her native Venezuela -- hasn't cooperated with police. Last Wednesday, investigators served a search warrant on Madison, removing a video camera and iPhone, both of which are said to have evidence of the injuries.

The investigation has led to Superior Court Judge Katherine Feinstein to withdraw from administering his oath of office. She made the decision so as not to create a conflict should the case move to her court.
